Terms of Use

Spark is a writing warm-up application that provides exercises and features designed to help users begin their writing process.

Spark functions as a creative support tool. It does not guarantee specific results, literary quality, productivity, creative performance, or individual outcomes.

Users in the United States must be at least 13 years old to use Spark.

Users who have not reached the age of legal majority in their state or country of residence must use Spark with the knowledge and authorization of a parent or legal guardian, particularly when making purchases or subscribing to paid plans.

By allowing a minor to use Spark, the parent or legal guardian agrees to these Terms and assumes responsibility for purchases authorized through the Apple Account used on the device.

Certain Spark features require the creation of an account.

The user is responsible for:

1. providing accurate information during registration;
2. maintaining the security of the authentication method used to access the account;
3. preventing unauthorized use of the account by third parties;
4. contacting support if unauthorized access is identified; and
5. using Spark in accordance with these Terms and applicable law.

Spark accounts are personal and may not be sold, assigned, transferred, or made commercially available to another person.

All texts, ideas, and other content created by the user during Spark exercises remain the property of the user.

The full text entered during exercises is not retained in Spark’s backend as permanent account history. It is not used to train artificial intelligence models, analyze the meaning of the user’s writing, create new exercises, or produce advertising profiles.

Certain information derived from an exercise may be stored, such as its duration, completed stages, exercise type, and technical completion data, as described in the Privacy Policy.

Apollo does not acquire any intellectual property rights over texts created by the user through Spark.

Spark may offer:

1. free writing warm-ups;
2. individual packages of writing warm-ups;
3. subscriptions providing unlimited or expanded access; and
4. temporary promotional benefits.

The features, price, duration, and conditions of each product will be displayed within the application before the purchase is confirmed.

Apollo may modify the availability, characteristics, or prices of plans and packages for future purchases. These changes will not retroactively alter benefits that have already been purchased and remain valid.

Writing warm-ups purchased through a package are linked to the Spark account used for the purchase.

Purchased writing warm-ups do not expire. They remain available until they are used or until the associated Spark account is deleted.

Writing warm-ups:

1. cannot be converted into cash;
2. cannot be transferred between accounts;
3. cannot be sold or commercially distributed by the user; and
4. will be permanently lost if the associated Spark account is deleted.

Before account deletion is confirmed, Spark may display the number of unused writing warm-ups and inform the user that they cannot be recovered after deletion.

Purchases made through Spark are processed by Apple through the App Store and the Apple Account used by the user.

Apple is responsible for processing payments, charging the registered payment method, issuing transaction receipts, and managing the transaction within its systems.

Apollo does not receive or store complete credit card details or other complete payment information registered with the user’s Apple Account.

Refund requests related to App Store purchases must be submitted through the channels provided by Apple, subject to any rights available under applicable law.

Use of the iOS version of Spark is also subject to Apple’s Standard End User License Agreement, available at:

If these Terms conflict with Apple’s Standard End User License Agreement regarding the license or use of Spark on Apple-branded devices, Apple’s Standard End User License Agreement will apply to that matter.

Spark may offer an automatically renewing subscription with an initial duration of three months.

The subscription automatically renews for additional three-month periods until canceled.

The user’s Apple Account will be charged the price displayed by Apple when the purchase is confirmed and at each subsequent renewal. The exact price may vary according to the user’s App Store country or region, currency, taxes, and Apple pricing settings.

The subscription price, duration, included benefits, and automatic renewal conditions will be presented before the user confirms the purchase.

The user may view, manage, or cancel the subscription through their Apple Account:

Settings > [your name] > Subscriptions > Spark

Cancellation prevents future renewals. Access to paid features may remain available until the end of the period already paid for, according to Apple’s conditions and applicable law.

Deleting Spark, ceasing to use the application, signing out, or deleting the Spark account does not automatically cancel the subscription.

Any subscription price changes will be handled in accordance with Apple’s rules and applicable law, including notice or renewed consent where required.

Deleting a Spark account and canceling an App Store subscription are separate procedures.

Deleting a Spark account:

1. does not automatically cancel an active subscription;
2. does not stop automatic renewal through the user’s Apple Account;
3. does not constitute a cancellation or refund request submitted to Apple; and
4. deletes the account data, usage history, preferences, and unused writing warm-ups associated with the account, as described in these Terms and the Privacy Policy.

Before deleting the Spark account, the user is responsible for checking whether an active subscription exists and canceling it through their Apple Account if they do not want future renewals.

Apollo does not have access to the user’s Apple Account, payment method, or personal subscription management system. Apollo therefore cannot directly cancel an App Store subscription on the user’s behalf through Spark’s backend.

If the user deletes their Spark account without canceling an active subscription, Apple may continue processing renewals until the subscription is canceled through the Apple Account used for the purchase.

Charges processed after account deletion due to an active automatic renewal must be managed through Apple. Refund requests must also be submitted through Apple’s available channels, without limiting any rights granted under applicable law.

When account deletion is requested and confirmed within Spark, the deletion process begins immediately.

Deletion may include:

1. account registration and identification data;
2. usage history associated with the account;
3. preferences and settings;
4. purchased and unused writing warm-ups; and
5. other account-related data that Apollo is not legally required or permitted to retain.

Once completed, account deletion is permanent, and the deleted account data cannot be recovered.

Information that must be retained to comply with legal obligations, prevent fraud, resolve disputes, or exercise legal rights may be preserved for the necessary period, as described in the Privacy Policy.

Residual copies may remain temporarily in backups or technical records until they are removed through the ordinary retention cycles of the relevant systems.

Spark provides a feature for restoring eligible purchases processed by Apple.

Purchase restoration depends on:

1. Apple recognizing the original purchase;
2. use of the Apple Account associated with the original transaction;
3. the purchase being eligible for restoration; and
4. the availability and operation of Apple’s systems.

Restoring an eligible purchase or subscription does not automatically recover a deleted Spark account or restore account history, preferences, data, or writing warm-ups removed during account deletion.

The user may need to create a new Spark account before using the application again.

Spark must be used only for lawful purposes and in accordance with these Terms.

Users may not:

1. attempt to access accounts, systems, or restricted areas without authorization;
2. interfere with the operation, availability, or security of Spark;
3. exploit technical errors to obtain writing warm-ups, subscriptions, or benefits without authorization;
4. manipulate transactions, purchase records, or subscription information;
5. use automation in a manner that harms or disrupts the service;
6. copy, modify, distribute, sell, or commercially exploit protected Spark materials without authorization; or
7. use Spark to violate applicable law or the rights of another person.

Apollo may limit, suspend, or terminate accounts used fraudulently or in material violation of these Terms.

Spark’s application, interface, brand, visual identity, exercises, institutional texts, code, systems, features, and other protected elements belong to Apollo or are used under authorization.

The user receives a personal, limited, revocable, non-exclusive, and non-transferable license to use Spark while their account remains active and these Terms are followed.

This license does not authorize the reproduction, modification, distribution, sale, sublicensing, or commercial exploitation of Spark or its protected elements.

The user’s rights over their own writing remain preserved as described in Section 4.

Apollo may update Spark to introduce features, correct errors, modify exercises, improve the interface, or adapt the application to technical, operational, or legal changes.

Free features may be added, modified, or removed.

Temporary interruptions may occur due to maintenance, updates, technical problems, third-party services, or events outside Apollo’s reasonable control.

When a change materially affects an active subscription or a valid purchase, Apollo will respect the conditions presented at the time of purchase and any requirements imposed by applicable law.

Spark may depend on services provided by third parties, including authentication, hosting, infrastructure, technical analytics, application distribution, email communication, and purchase processing services.

These providers operate under their own terms, privacy policies, and technical systems.

Apollo does not control the permanent availability of Apple’s systems or other third-party services but will take reasonable measures to maintain Spark’s operation.

The service providers used by Spark and the related processing of personal data are described in the Privacy Policy.

Users must also comply with any applicable third-party terms when using Spark, including the terms governing their Apple Account, App Store purchases, device, internet connection, and mobile service.

Apollo is responsible for operating Spark within the scope of its activities and in accordance with applicable law.

To the extent permitted by applicable law, Apollo will not be responsible for losses resulting exclusively from:

1. the user’s device, internet connection, or operating system;
2. loss of access to the user’s Apple Account or authentication method;
3. continuation of an active subscription after account deletion when the user was informed that the subscription had to be canceled separately;
4. third-party services outside Apollo’s reasonable control; or
5. creative, professional, or personal decisions made by the user based on Spark exercises.

Nothing in these Terms excludes or limits any consumer, privacy, warranty, or statutory rights that cannot legally be waived under applicable federal or state law.

The processing of personal data through Spark is described in the Spark Privacy Policy.

The Privacy Policy explains, among other matters:

1. the categories of personal data processed;
2. the purposes for which the data is used;
3. the service providers involved in Spark’s operation;
4. how long the data may be retained;
5. how users may exercise applicable privacy rights; and
6. what happens to personal data after account deletion.

The Privacy Policy forms an integral part of these Terms of Use.

Apollo may update these Terms to reflect changes to Spark, its products, third-party services, business practices, or applicable law.

The updated version will be made available within Spark or on an official page maintained by Apollo and will include a new “Last updated” date.

When required by applicable law, Apollo will provide additional notice regarding material changes.

If a change requires renewed acceptance, the user may be asked to agree to the updated Terms before continuing to use Spark.

These Terms may be made available in English and Portuguese.

For users located in the United States, the English version will govern. For users located in Brazil, the Portuguese version will govern.

Additional translations may be provided for convenience.

These Terms are governed by the laws of Brazil, without excluding any mandatory consumer protection, privacy, or other statutory rights applicable in the user’s country or U.S. state of residence.

Any dispute relating to these Terms or Spark will be submitted to the competent authority or court determined under applicable law.
